When there's no lease agreement


What is the name of your state? Texas

My aunt has two homes on her property - her main home and a smaller home. She's decided to allow a distant relative to live in the smaller home rent free with no lease agreement in place. In addition, my mother currently resides in the main home with my aunt, and there's no written agreement/rent between them either. When my aunt passes away, my two cousins will inherit all the property. My aunt is in her mid 70's and her health is not good. In fact, we'd be surprised if she made it through the next year. If she passes away, and there's no lease agreement in place, can my cousins legally require my mom and the distant relatives to vacate the premises? Also, are there any steps my mom should take to protect any belongings she has in my aunt's home?

As far as belongings in the house get things settled in writting and as far as the family members who are going to live in the house they need to be given notice just like any other tenant when its time to change something and the notice must be in writting and sent certified mail . You can learn what your states laws are most of the time by using your state govt web page to search for them. OR your county govt centers law library. YES your county govt centers law library. its paid for with public tax dollars and the info in it is public.
