Wrongly Evicted


What is the name of your state? TX I was evicted for getting a dog. It is not on my lease that I can not have a dog. I was given a 30day verbal notice the day before rent was due. She has no legal right to evict. Do I have to pay this months rent? I am planning to counter the petition. I dont want to stay here. I am in the process of buying a house it may or may not be ready in 30 days. This eviction is causing undo stress and she is threating to call the financing company to stop my loan!!!

Misti First here , your mortgage lender will likely tell her they cannot assist her or speak to her about your mortgage application , for them to do so violates privacy, SECOND: Verbal notices do not count , In order for your LL to prove the content of any communications to you like notices they need to be in writting sent via means that gives LL a rct. Third: yes you need to pay your rent , Send your rent via confirmed mail delivery. Do your self a favor , since you said the lease does not forbid you from having a dog and make a copy of the lease and store it some where away from home.

And you are not being evicted. Your landlord simply is not renewing your month to month lease.

Get rid of the dog. An eviction on your record whether justified or not will gum up the works in the purchase of your home.

The lease agreement may not mention that “tenant is not allowed to maintain aliens on the premises,” but, nevertheless, aliens cannot be keep on the lease premises! Give it some thought. The LL said the dog is a no, therefore, the dog must go. Is it worth a battle nearing the end of the lease just because you chose to purchase a pet premature to moving into a private residence? (rhetoric question)

Your landlord has the right to evict provided she does it the way required by Texas law.

You should have gotten permission in writing to have the dog.

The rent must be paid. You may think you can contest the dog issue; however, the power will be in the landlord's hands if you don't pay the rent.

Have someone keep the dog until you close on your new home; pay your rent; BE NICE TO YOUR LANDLORD!!! If/when you close on the purchase of your home she can sue you and if she gets a judgement against you it will record against your new home....BE SMART, BE PROACTIVE, BE COOL!
