YOU have no claim on the retainer UNLESS you are the valid personal representative of the estate (as set by the probate court).I hired the attorney ,I singed the employment agreement for my father via the poa the employment agreement is in my fathers name so is the reciept for the 9,000 he did do some work on the case but considering charges were still pending he did not do 9,000 worth of work
As noted in my previous post, the OP has NO right as the attorney-client agreement is in the name of the deceased.I recommend you contact the State Bar of Texas to take advantage of its fee dispute procedure.
The OP can do nothing. Only the respresentative of the Estate can do anything and we do not know who that is. We also don't know how much work was done or anything of that nature. And calling names will get you nowhere except sitting on the sidelines for a bit. That goes for everyone.At some point, if the fee dispute isn't resolved between the attorney and the OP or the Estate, the best and least expensive remedy to pursue is through the State Bar.
The POA (Power of Attorney) means nothing. It died with the affiant.The OP has stated she has some POA
If you have to even ask "if he she isn't the right party", then you are admitting that you have NO legal knowledge or education.... and your posts are a danger to those who you try to offer 'advice' to.Of course whatever action is taken has to be taken by the proper party, but I think it is important that the OP be aware of the fee dispute process with the Bar. If he or she isn't the right party to pursue it, then at least the info can be passed along.
