By court order I was supposed to execute release of my income evidence (for child support) within 45 days. I gave my atty. everything within 15 days, but he was late (by two months) delivering it to the opposing counsel. We were supposed to go into mediation. The opposing counsel canceled because they did not have the income info. Now, three weeks from the final hearing, I feel I may be charged for violating the temporary order. My atty. promised he would write to opp. counsel and explain what happened, and that's how he actually kept me hanging instead of switching atty., but he never actually fulfilled that promise. He actually argues that the opp. counsel made a mistake by cancelling a court mandated mediation.... How, I wonder, if they can argue they waited until the mediation date to have my income info, which was also by court order. (By the way, I never underpaid child support). With such a short time from the final, is it wise for me to hire a new attorney? (the case is also very contentious and has had complicated ramifications a new atty. would need to be updated with). And on the basis of the above, can I report my current atty. to our state Bar Association or write a complaint with the Office of Supreme Court, Committee on Professional Conduct? |
