Bad attorney?


What is the name of your state? PA

We went to small claims court in June 2005 and won. (Defendant [a contractor] appealed). At this point we hired an attorney, and paid him $400.00 He filed with the prothonotary in August 2005 and I have only heard from this attorney 2 times in almost 2 years. He will not return phone calls or acknowledge e-mails. And I do not call that frequently.

Today I called prothonotarys office to see if anything has been done and they informed me that this will expire in August as there is a 2 year time frame.

I cannot afford to hire another attorney, let alone the money we lost on the faulty project that origionally brought this on.

What should we do?

Sue that lawyer and sue him hard. Charge him interest and file for all damages caused by the delay. Have no mercy on him at all. That's what I'd do. See if you can do it without hiring an attorney. Represent yourself. Attorneys are usually worthless. They work together only to benefit their pocketbook or wallet.
He most likely took your $400 and played golf later that day with it, took his family out for a nice dinner at Ruth's Chris steakhouse and then probably bought some more chrome doo-dads for his mid-life crisis motorcycle off the internet.
