BAD Public Defender ! ! HELP

What is the name of your state (only U.S. law)? Florida

I was given a public Defender 6 months ago and the Public Defender
stated to me recently, it's better to take any plea then attempt to
take this case before a Jury or Judge. My words were "I did not do this
and I'm 100% innocent. "Grand Theft"

The PD said it is 100% better to take the offer and
be 100% certian of no jail time as a Jury may fell you did this.

I don't want no deal as I did nothing. While the deal would be a good
deal if I did the crime, I see it as it's fast and over for the PD if I would
take the deal.

Now set for trial, The PD has done nothing.. Not one Depo, and is still
wanting me to take a deal. He final words to me today was we are going
to trial and when we lose and you go to jail it's your fault for not taking
the deal.

I have a repair shop, we took on a car for repair and the customer was
to provide the parts. She paid labor in advance, but never delivered the
parts. We disassembled the car, and in the end put it back together minus
the parts she never gave us.

The Police arrested me for grand theft as I did not refund her money as
I did what I agreed to and paid others to work on the car. The agreement
is in writing and I believe it should be in civil court however he son is a
police officer in the department that arrested me. She had 90 days to
give me the parts and she did not do this. My costs were the same to
tale it apart and put it back together with old parts.

I brought the lack of assistance up with the judge and he said he knows
the attorney is a good attorney and denied me any change. My attorney
says just because we had a written agreement it don't mean he will be
able to get it into evidence and he refuses to go over any witnesses or
questions I would like asked.

So my Question is how do I get another attorney other than punching this
attorney out in the courtroom before the Judge and get another charge?

HELP!

I watched on Court TV this weekend a defendant telling a Judge he would
rather be defended by the prosceutor than his Public Defender and the Judge
said he did not get to choise his attorney. He then Sucker punched his PD
and got a new attorney as well as additional charges.

Any ideas... I know pay an attorney but that's not an option.

I would not have been appointed a Public Defender if I could
afford a Private attorney! So that is not an option.

Are you sure there isn’t more to this story? A first year law student would know that this scenario presents no elements of a criminal act!
 
Rob, help me out here. I'm not sure this makes sense to me. You apparently own a repair shop. You were able to pay your employees to do the work, however, you are indigent?

That is just not computing for me.

I have a SMALL repair shop, I'm one of 2 mechanics and have a helper.

After working last 10 years for Dealership I started this business.

I put 100% savings into business a year ago, Buying property and living
day to day and now that I was arrested business is closed, got tired of
being visited by police every day. Not good for business.

I learned it's not good business to do work for a Police officers family
as they really are the law and can do whatever they want.

Sad thing is I charged fair prices and did alot of work at low cost
just to make ends meet and to be fair.

As for not being the WHOLE story, it's not, but the main points are
there..

I learned something today. A Public Defenders job is not to defend you
but to make sure the State follows the rules in bringing the case before
the court making sure you get a fair trial.

I was told by the Judge it's not their place to bring forth evidence that no
crime was committed by the defendant, but to make sure the evidence the
State brings is proper thefore until the trial is over I can not file a claim of in
effective council.

So, I guess it's just me and the other people I meet in the courthouse
that are wrong when we say the Public Defender sucks.. and there is no
way to get a different attorney because we feel the Public Defender
is not representing us until we lose our case and are in jail because of it.
