| Can courts hear motions immediately in case of emergency? What is the name of your state? Vancouver, Washington
My parents are involved in a civil litigation to evict from premises for breach of contract in a business sale and failing to pay rent. My parents are the
petitioners in the case. My father is in hospice, dying of cancer and my mother has turned over POA to me to settle the case for her. Approximately 34k is being held I am assuming by opposing councel where 18k is being disputed. I have asked the attorney representing my parents to file an emergency motion to ask the courts to release the remaining funds to my mother as she is facing unexpected expenses for burial and because the money owed is all they have to live on outside of Social Security benfits.
2 weeks after my request, the papers were finally files but the court date is a month and a half away. My father will surely be dead by then. When I questioned why the*matter couldn't be heard sooner I was told they had to follow rules and the same judge had to hear the motion. Is this true? Or is the attorney of record wasting time and money for his own benefit?
