DA gone bad?


Iowa. I, and my cousin, plead guilty of some felony crimes a couple years ago. The police "caught" us because our other cousin, who helped us with the crimes, turned himself in (not sure why, concience?). In any case, his mother campaigned for, and worked for, the district attorney. So, of course she took her son directly to her boss and asked for immunity. Thus throwing us under the bus.

That same DA is now disbarred due to other issues in his professional career and we are looking to see if it would be possible to sue the state, county, city, former DA, or anyone else to show that a favor was performed.

I guess you could consider me trying to get "revenge" against my cousin for the prison time I did but honestly he too should be punished for his participation in the crimes and so should his family and that DA who helped him get away with it.

So you were "ratted out." The important thing is that you and the cousin were apprehended and jailed for your crimes.

Anyone who says you should be able to make money off the situation is out of their minds.

I don't want money. I want both of them to be punished for what they did. A corrupt DA and my other cousin who helped with the crimes. I would be willing to PAY to see them punished.. not GET paid.

Sounds like a plea bargain was worked out with the DA, which is perfectly legal. I'm not an attorney, but the DA might have decided that it was more important to get you and your other cousin behind bars than someone who needs his mom to speak up for him. That's speculation, of course, since you don't say what the felony was or what part each of you played in commiting it.

Lets say you sell me drugs. I pay you, then you discover that the money I paid you with is counterfeit. Can you take me to court and sue me for the money I owe you? You could, but you wouldn't win because the "dirty hands" law applies. I'm a drug addict and a thief. You're a drug dealer. The court is not going to, in essence, reward you for being a drug dealer by restoring the money you were paid to break the law.

You and your cousins collaborated in a crime. The city, county and state are not going to put your cousin in jail to be "fair" to you. You chose to break the law. The court system put you in jail.


I seriously doubt that any attorney will take your case. Instead of plotting how to get even with Cousin Rat, kick yourself for being stupid and get on with your life.
