Filing paperwork question


What is the name of your state? NY

Hi, I wasn't sure if this question belongs here or in Real Property, but here goes....

The previous owner of my house granted an easement to the next door neighbor to use his property for a specific purpose. When he was presented with the paperwork, the neighbors did not fully explain what the easement was for, nor the size of the easement area. He also did not sign the paperwork in front of a notary public.

I realize I may be reaching here, but is there any hope whatsoever of fighting/revoking the previously granted easement right based on (1) possible misrepresentation of what the easement was for and/or (2) not signing in front of the notary?

Already spoke to a lawyer who was iffy as to pursuing this; he's friends with the other lawyer (small town stuff) and didn't seem to want to ruffle his feathers (or get the notary in hot water)...

Was the easement recorded?

Yes, the easement was recorded in 1999.

Help??


Hi, I wanted clarify that, although the document was notarized, the signor did not actually sign in front of the notary. That is, it was delivered by another party to be notarized. I also did some research about notary duties and one is to ask the signor something about are you aware of what this document means.....Thanks for any and all input/comments on this issue.
