Hello have a ?In a court room, can the Defense Attorney be related to the Prosecuting Attorney? Could be considered, "Conflict of Interest? |

| This is court appointed attorney's. One related to the other. There is nothing wrong with that. |

| Too explain better, if on the same case one side defending you and the otherside procecuting you, and they are lets say, brother and sister or cousins. Thats ok. |

| Ok, the county I'm in, the prosecuting Att. is related to the Defense Att. they are cousins. I'm just wondering can they do that??? Or is that concidered conflict of interst? |

| The fact that they are related, in itself, does niot constitute a COI. |

| I guess I just find that startling, the one that is prosecuting persons is related to the one that is defending persons. Somehow to me that seems funny, not haha funny. |

| Seems to me that they would have to disclose that to both sides, and both sides would have to agree to allow it. |

| I don't think they have a problem with it as much as the persons being put on trial. In the county where I live everyone is related in the court house. I don't mind them being related and lawyers, just in the same courtroom working on the same case. As well as others in the community. Last edited by onizzle25; 04-19-2009 at 04:06 PM. |
