I want to trust my lawyer, but...

I have had a dispute with my mortgage company since the beginning of October. My lawyer took our case to try and work out a settlement for the mortgage co.'s negligent handling of our loan origination. This lawyer informed me that mistakes were definitely made and we had a solid case. He received the case at the beginning of October and contacted the mortgage branch manager with a letter stating the problem. After not hearing from them for about a month, he called them and was told that the letter was transferred to their legal department. We heard back from the legal department in December stating that no mistakes were made based on the info that they received from the manager. However, the manager did not submit all of the relevant info and so my lawyer wrote them a more detalled letter along with supporting documents to show exactly what happened. We have not received a response in almost 7 weeks. My lawyer has called twice and not received a call back or response of any kind yet. He said that he hasn't had time to call them more because he is too busy with court and other clients. He did say that he is still going to try, but it may take some time. He said that it is better not to be too aggressive and to be patient. I am wondering if there is any time limit for a response. We are begnning to wonder if he is giving our case enough attention. He said that he will charge by the hour and we haven't received a bill yet. His office is known for being a bit laid back and taking their time. Is he right to be cautious and take his time? I am thinking that we shouldn't have to tiptoe around too much when we are not the one's who messed up our loan. So when is enough, enough? Or am I just being impatient and it's normal for situations like this to take a lot of time. Thanks!

If you are not comfortable with the way your lawyer is handling your case, then by all means go talk to him.

However, dealing with these mortgage companies can be very frustrating and very time consuming. The time it is taking is not, in my experience, a long time.

Thank you. I have spoken with him about being more aggressive, but was told that the best approach is to be patient. I just wanted to make sure that it wasn't being neglected. So for now, we will sit tight and wait for a response. At least they must be considering our evidence or I think they would have gotten back to us a lot quicker.

No actually I am pretty sure that they are on pins and needles making our case their top priority! LOL
