Incompetent-Unethical Lawyer???


What is the name of your state? TEXAS

In August 2007 I paid in full to have a lawyer file a petition for post-conviction relief (Habeas Corpus 11.07). He told me to be patient, but he never updated me on the status or events of my case. So every couple of months, I would call him to ask how my case was going. As usual, he told me to be patient. Finally in May 2008, he told me that my case had been dismissed for noncompliance because he had filed the writ under the old format. Then he arranged for me to go sign a revised writ to be refiled.
Another six weeKs passed and I heard nothing from this lawyer. Having lost all my confidence and patience with the lawyer, I decided to personally investigate the events of my case. Researching on texascourtofcriminalappeals.com, I discovered that my case had been dismissed since December of 2007. Inquiring with the Dallas Distric Clerk, I learned that the revised writ I had signed 6 weeks ago was not yet filed.
The very next morning without appointment, I waited for him at his office. I signed a new writ, had it notarized, and walked him to the courthouse to have it filed. Nearly a year has gone by, and I am back to square one. The outcome of this case is close to life and death. This lawyer has caused me to have lots of mental stress. There are also financial issues because of his prolonging or delaying my case.
