IVF/ICSI Procedure What is the name of your state? CA
Three years ago I underwent IVF with ICSI to get pregnant. The procedure was a success and I gave birth to full term twin girls. My twins were born weighing 6.1 and 6.4 and were very healthy at birth. At 2 months I lost my daughter Erin to SIDS and at 6 months my daughter Emily was diagnosed with developmental delay/Autism/ and the nuerological condition Nuerofibromatosis. Neither side of our family have any history of dev. delay./Autism/or NF.
I *(at the time 28) was a very healthy woman who had been unsuccessfully trying to get pregnant for 1 year. Dr. Immediately suggest IVF (no fertility drugs given) Eager to get pregnant fast I agreed and paid. I DID NOT however agree to the ICSI procedure. I read the paperwork and some of the complications with children born from ICSI and decided it wasn't for me. I believed that was "messing just a bit to much with nature" ICSI was out and I signed a piece of paper that said DO NOT perform ICSI. After my eggs were implanted the nurse came in and told me the procedure went well and the IVF/ICSI procedure was complete. I immediately sat up and said I had not agreed to the ICSI part. She said she'd speak with the Dr. and get back to me (it was also an additional $2,500) Hours later she called me and said since it was their "mistake" I wouldn't be charged the fee. I was concerned but I think my feelings of elation about actually getting pregnant took over.
Since then, I have researched some of the "anecdotal" findings on ICSI and believe my daughter Emily's problems are a direct result of the ICSI procedure. Do I have any re-course. Should I consult an attorney? Do you think I have a case?
I don't believe it had anything to do with the loss of my daughter from SIDS but, I do believe there is a link with my other daughter? Fifteen months after the girls I also managed to get pregnant, unassisted, while nursing, and gave birth to a very healthy (now 2 year old) son.
I really believe there is a link. Could I hold this Dr. Responsible? Isn't this a part of malpractice.
p.s. I've never sued or considered suing anyone before in my life.
