| A law firm countersued me and then sent a FDCPA notice of an amount due Here is the situation: I am in Texas. A major bank sued me for breach of contract and a writ of sequestration. They got the writ then dropped the case. I then sued the bank for breach of contract and they then counterclaimed me. The law firm representing the bank that counterclaimed me then sent me a FDCPA letter where they are now acting as a debt collector. So the questions are as follows: 1) can a law firm act as a defendants attorney AND as an independent debt collector trying to collect the same amount of debt on their own and 2) what is, or could be, the purpose for the law firm doing both a counterclaim and act as an independent debt collector.
