Lawyer Malpractice

What is the name of your state (only U.S. law)? NJ I posted regarding a motion filing but does anyone know if it it malpractice if the attorney doesn't follow-up with the necessary motion as allowed by the judge in the allowed time frame?If financial documents aren't turned over income cannot be determined for settelment,assest distribution,or alimony.What recourse do I have?

Get a new attorney who can advise you how to fire the previous one and file a complaint with the state bar association against him. Did you pay a retainer and is there a signed contract/fee agreement with the first attorney?
