Lawyer withdrew from case because I called her on her cellphone?


Clarksville, TN. I called my lawyer to ask a question about why I didn't get a tempory custody schedule in regards to a parental parenting petition. During the docket call hearing she had told me I was going to get when we spoke a couple of days before the docket hearing date. And she called me back she went crazy, screaming and yelling at me because I called her on her cell phone and left a message. On top of that she withdrew from my child custody case and charged me 2300 hundred bucks for doing nothing other than get a docket call hearing set for trail date. I have since file a complaint with TN Board of Professional Conduct. They are reviewing my complaint. I have since had to hire another lawyer, who in my opinion isn't much of a lawyer either. Are they all like this ? I had to respond to her response in which she totally lied about the entire situation. This is unbelieveable, that they can do this and get away with it. I see why lawyers aren't very well liked. This is a pretty small town. She's married to a judge, her law partner is married to a judge. And no one in this town wants any part of taking this case to law malpractice case against her. What are my chances getting my money back from this law firm?

In my limited experience, TN is more corrupted than it is typical for US. I had a fee arbitration hearing for a case when a lawyer screwed up, and won it, got my money back, but not in TN. See if they have similar committee here, good luck. Board of Professional Conduct is a good choice too, however, being well connected seems to be the deciding factor in TN. To find a lawyer if you have no reference, I would look up published appeals and see who wins them, or go to court, sit there and hear the presentations. If you find someone you like and he does not want to take your case, ask if they could recommend someone.

The new lawyer I hired turned out to be an excellent lawyer, in the mean time the complaint I filed against the first lawyer just continues to go back and forth. He said she said. How long can this go
on. Seems the board doesn't really want to do anything about it. In response to what the response from the other poster said, he is right, Connections in TN seem to be the name of the game. She has alot and I have none. It really seems like they can do and say anything they want to she has turned this whole situation around making me look like the fool. I'm so tired of this and thinking about forgetting the whole matter. It's all been a waste of time and a joke. I think the whole legal
system here in TN is crookit.

Unfortunately, family law is rife with CROOKED from judges to lawyers and back again. But it isn't limited to Tennessee. Sadly, there is little one can do. Remember the professional conduct org you complained to is made up of LAWYERS.

Good luck! I'm fighting some serious crooked judges and lawyers here in Colorado and I really don't have any hope of prevailing or even limiting their power and corruption. Sigh.

Question re SOL and filing malpractice.


I fired an attorney for working for the other side, which he admitted.
He also intimated that the 'collusion' (my word) was 3 way: essentially that in family law the judge and the 2 lawyers decided what was happening prior to the trial and decision. When I fired him he agreed that he'd only take what money the court awarded him paid by X. He lied. Meanwhile I appealed the decision that the attorney helped 'win' for me as there were serious legal errors. (ordered to sign a fraudulent joint tax return 3 years after our divorce for one).

The appeal was affirmed with exception of our marital art collection being 'separate property as a result of a residual cluase of a will' which was determined a judicial error. BUT, I still didnt get a share because I didn't get the paintings appraised. That was because my X stole them from the marital home and refused to allow an appraisal. I told my attonrey to file a motion to compel but he argued against it, saying I didn't need the appraisal.

There were lotsof other 'issues' that I believe caused damages but I'm afraid that they'd be barred by SOL....So, my question is since damages have to be shown and since I first had to wait for the property division ordered by the judge (a year) and then I appealed so as to get relief from the damages...would that stop the clock on the SOL? If not, how about if the appeal court brought up the new issue of the reason I didn't get any of the art collection value ($500k) was because I didn't have the art appraised just recently...would the SOL for THAT start now?
