Is there any circumstance in which an attorney's failings in a civil trial offer any grounds for appeal? Is there any way in which those failings might be at issue in an appeal?
On the one hand, it would strike me as a bit unfair to the prevailing party whose counsel performed appropriately. On the other hand, with all props to the good lawyer, I don't want to leave anything out, so while I do have other grounds for the appeal, if this could be at issue in any way, I guess I better consider it before filing the designation of record.
Since I am appealing a decision in a BK court, this would be a federal appeal.
