Legal Malpractice (Matrimonial)

What is the name of your state? NY

I signed a separation agreement with the help of an attorney on November 4, 2004. I ran into trouble implementing the terms of the agreement and requested help from the same attorney on February 12, 2005; he helped me until March 15, 2005 without signing a new attorney-client contract.

There are significant problems with the separation agreement. I filed a legal malpractice law suite against the same attorney on March 4, 2008.

In NY, the statute of limitation is 3 years. Three years from November 4, 2004 is November 4, 2007; but three years from March 15, 2005 is March 15, 2008. Am I within the statute of limitation? Do I need to cite specific laws or cases to drive my point home? (Which ones?)What is the name of your state?
