letter from lawyerWhat is the name of your state?TN I received a lien from an attorney and he included a paper on his letterhead that said "Notice of Consumer Debtor's rights under 15 u.s.c.a 1692(g). The note went on to say what my rights are. However, on the ones that talked about debt verification and describing my 30 days to dispute he added a line that said "However, the creditor need not wait the thirty days before filing suit upon the claim." I looked on the ftc website and this last line is not included in fact the next section specifically state that they should stop collection of this debt until verification is provided. My questions are: 1) Has this attorney done anything illegal by "adding" this line? 2) If so, what are my options for dealing with him? |

seniorjudgeSorry to offend you by double posting, However I do not look at every single category on this site and I'm sure most people do not as well. I posted it in two places since it fell under both categories. Thank you for replying though, even though your replies and links answered neither of my questions. |

| The attorney did nothing illegal or unethical. It won't get you out of paying the debt.

letter from attorneyPerhaps I should be more clear. The debt was a valid debt and it has been paid. I am not trying to get out of paying anything. However, the FDCPA is clear about misrepresentation. This attorney sent a note under the guise of the FDCPA when what the note said is not what the FDCPA says. However, thank you for your responses. |
