loans against lawuits?


What is the name of your state? NE

Not sure where to have posted this question, so if someone has a better board, please let me know.
I have a lawsuit that is to pay out at the end of September 2005. Name as attorney set up on lawsuit is minor child trust fund pod mother. mother has terminal illness, bio father dec'd previous. do have paperwork on file that states child goes to fiance of mother in event of mothers death and becomes legal guardian.
With the wording on suit now.....am in need of some funds for medical expenses and such. Have heard of "lawsuit loans" but can i legally do a loan against lawsuit that is in my childs name alone?

And if no loan every done, second question, when this pays out it goes to a trust fund in childs name that is marked and labeled $5000.00 can be withdrawn per month by child until the age of 25 when trust becomes childs.

did i set this up all correctly to protect child? And can it be swtiched if we would like, or not benefical to do so?
And what are the drawbacks of a lawsuit loan?
