| Marsden Hearing What is the name of your state (only U.S. law)? GA
My son is in jail and is represented by a court appointed attorney. This attorney has expressed displeasure at working for $25.00 per hour, does not communicate with my son or me (I have his POA and have given it to the attorney), NEVER returns calls and failed to show up for the arraignment. The DA kept putting his hearing on hold, and when the courtroom was needed for a jury trial, left one of his staff to call him when my son's attorney showed up. One of our party went up to the DA's office and overheard another lawyer and a cop speaking very snidely about my sons attorney, simply not showing up and not informing the court, and was having knee surgery. We couldn't believe that he didn't have his office inform the court or us (he has our numbers) and I had verified with his office that he was indeed scheduled for the Wednesday hearing. We simply couldn't believe it so called the hospital, and asked for him by name to verify that he really wouldn't be there. We were told that he had been released from the ER on the Saturday before. Our assumption is that he then had to get an ortho on Monday and had knee surgery. He has an office and an unpleasant secretary, but no one was informed. He has not spoken to me son except the day he was appointed and at the bond hearing. I have left him messages. None returned. I have sent him faxes, left notes and letters thru his mail slot, and still no response.
