I have questions regarding a criminal attorney's responsibility for filing for a motion of discovery. Two people were charged with possession of precursors and hired an attorney who they trusted because he was an old family friend. The gentleman charged in the case was sentenced to 3 years with 27 suspended. He is currently in a correctional facility. The woman charged was sentenced to 5 years probation. On plea bargaining day, their attorney said he would talk to the prosecutor. He said that was the best offer they could get. Scared of a longer sentence if it went to trial because of what their hired attorney told them, they took the plea. This occured at the end of July. Today the woman found out that the attorney they paid to represent them DID NOT EVEN FILE FOR A MOTION OF DISCOVERY. During the time before court he acted like he was working on their case. When she stopped by his office today to ask for it, the attorney said he would have to talk to the prosecutor about getting it. The daughter of the couple had called the attorney earlier in the day and he told her he had the motion, but come to find out had not even filed for it.
