Hi all,
I have been married almost 5 yrs to US spouse, green card more than 3 yrs, sometime in 2006 spouse and I went through marital difficulties, he took me to court for slappinghim, which in fact I did after he assaulted me 1st. We reconciled ,case never went to trial or anything like that, the judge recommended I apply for expunging of record after case was dismissed. I want to apply for my citizenship but am not sure what box to check on the form re arrest I was never arrested, both of us charged each other w/assault. Will this impact on the application negatively?
Help anyone.

What do you mean "he took me to court"?

Either you were charged with a crime or you weren't. If this was a purely civil matter in family court or such then there is no issue. But if you were cited for assault you will probably have to report that--even if it is "expunged," which doesn't matter to the Feds. Keep your nose clean, if there was no trial or conviction and it was for a petty domestic incident, it shouldn't cause trouble. You need to have your green card for 5 years to naturalize. If you haven't already, you should file to remove the conditional status on your green card.
