Paying the attorney


What is the name of your state? New York
A not for profit corp in NY....hired an attorney to review our insurance and liability position in regards to a skier being injured during a ski race. He originally quoted an amount of $500 which the board authorized. So far he has billed us for $680 and now informs me he had made a billing mistake and neglected to bill us for another $440. Do I have to pay for his mistake?

Did you or anyone else on the board sign a fee agreement with him? Do his billings give a detailed description of exactly what services he performed per billable hour?

If not, then refuse to pay and let him take you to small claims court. This is unethical behavior.

No fee agreement was signed and his billings do describe what services he performed. He says he was not told to get authorization for anything over the $500. We have not recieved a bill for what he says he overlooked charging for...he emailed me and told me he missed these charges and will be sending another bill. My issue is that he made the billing mistake when he sent the first invoice now wants to get paid for his billing error. It would be one thing if he actually did anything for the $. but what he has done so far is unacceptable.
