question


We were involved with an internet attorney, whom after questioning his billable hours and a justification of billed hours and work completed, we were dropped as clients. We contacted the State Bar, but were denied any actions. Where do we go from here?

You filed a complaint with the state bar? What do you mean exactly when you say they denied you any action? Normally, the state bar will investigate and render some sort of decision - they never recommend or offer any action to you. When I filed a complaint with the California State Bar about an attorney, they decided not to discipline him, and recommended that we take it to arbitration. If they had decided to discipline him there are levels of it, where he may be chastised and put on record (for the least of offenses) or disbarred (for the worst of offenses). Any discipline rendered by the state bar is going to hurt his career in some way.
I chose not to go to arbitration - instead I sued him in small claims court. He got special dispensation to have one of his junior attorneys represent him, and the judge ended up rendering a verdict partly in my favor so some of my money was returned. Whatever else the lawyer I sued got from me was spent on sending his junior partner down to court, and having him write a ridiculously huge response to my suit. Since it was never given to me before the hearing, the judge just threw it out.
Depending on your state, your only recourse now is small claims court or a civil suit, depending on the amount of money involved. Did you ever visit or meet with the guy in person? If you didn't, I'm guessing you are going to have a hard time holding him accountable.

If you no longer needed his services, what do you want him to do for you now? Did you sign a fee agreement with him? Are you wanting a refund of monies already paid?
