Question

Refund request

What is the name of your state (only U.S. law)? Florida
I had paid $100 for a consulation to a lawyer to file for joint custody of my son. During this consult all parties names were released to the lawyer, and he agreed to take my case and file the papers with the court. He next called me in once they were ready to read and sign, and also had to give him $500. The next day, I was called and told that due to a conflict of interest with the other party, he was not able to take the case; however, because he had drawn up the papers I was NOT getting a refund of the $500. WOW, I didn't try and fight it at the time because I was afraid that someone with his connection I could possibly loose my pursut to gain joint custody. Recently in Okaloosa County there have been so many officials arrested and charged for corruption in their offices, it comes to me again to approach this because it just doesn't seem fair. I gave him name and addresses, and he didn't know he had spoken with them until after I gave him the $500.00. I am writing him in hopes that his conscience is going to allow him to return to me that money. I pay child support and now, and getting this back would help a lot. It seems only fair. I don't have the $ to challenge him in court. Other than writing to his office and mention what I have here is my only recourse or does someone have another ideal? Thanks:

I suggest that you file a complaint with the Attorney Grievance Commission in your state.

Maybe there is a website for the Florida Bar Association where you could file a complaint. However it may turn out that you are due only a partial refund--he deserves compensation for the actual work that he did but he should have presented you an invoice that shows billable hours (an itemized description of exactly what services he performed and his rate per hour).

Did you sign an actual contract or agreement to use his services?
