Retract a lawyer retainer?


What is the name of your state? Wisconsin

We have paid a lawyer $ 5000 dollars as a retainer and this was three weeks ago. This lawyer has done nothing and also has given bad advice to us. We have personality conflicks and I would like to fire this firm. I am sure they have maybe only used 1500 - 2000 dollars of the retainer money. Can I fire them and ask for the remaining money back for another lawyer??

Yes we did sign a Retainer agreement which does state non-refundable.

My question is : Is there a layers ethics code that says they should return un-used portions if the lawyer and client do not talk or get along with each other?

Actually I doubt the rules will state that you can get back any of the money for the reason you stated, if the agreement was that the retainer is non-refundable.
