Question

Second Marriage Assets

What is the name of your state? Florida

My husband and I just moved to Florida and purchased a home. Some of the money for the new home came from the sale of our former home, the balance of the money came from an inheritance I received.

We both have Wills that state, in the event that we both die the house is to be devided 50% to his four children and 50% to my two children.

I understand that Florida, law states that "when a spouce dies the home goes directly to the surviving spouce". If that be the case and should my husband survive me, he could sell the house, take the money and go live in another state with his children, or change his Will and exclude my children.

I do not feel that his children should be able to have any part of my inheritance.

How can I make sure that my children will receive there share of the home value and it's assets, in the event of any changes to the Will. (My inheritance. money.) How would you advise I secure this for my children?
Could there be a seperate contract or document other then the Will that can be implemented to help solve my problem?
I would appreciate any help you can give me.

Thank you,
P. Lukowski
