SSDI Lawyer Malpractice??


I am from WI. I have a SSD Lawyer that went to my hearing and I was talked into accepting a "Closed Period" on my case. I did not fully understand what that meant one thing my lawyer said after being in the hearing for about an hour and a half is that we could go back in there and finish, then the judge can decide not to give me anything at all. My mother was there when my lawyer was talking to me. I told him that I didn't understand what the "Closed Period" meant or what that means for me, what do I do if I do accept it. He said "Well, you just refile tomorrow."

When I received my decision in the mail from SSD, I was upset. It said that I agreed that I was no longer disabled!! I didn't know that I was agreeing to that.

I told him I wanted to appeal. I also told him, in a letter, that when he got the appeal done that I wanted to come in and review it with him before it was sent out. I have a voicemail from only two days ago from him stating that he would like to know if it was ok to send in or not. I just foud out that it was mailed without my consent...

Anyway.. that is part of my story with my SSDI Lawyer. I am really upset about everything that has happened and it was suggested to me that maybe I should go over this with another lawyer because I may have a legal case against him??? If anyone can give me advice, I would sure appreciate it. Thanks

You shot yourself in the foot by signing the form--if you did not truly understand what you were reading you should not have signed it.

This does not meet the legal definition malpractice and you can not prove that the outcome would have been different had you not signed the form. Now you should post your question on the message board for SSI Disability Law questions, AND consult with a local SSD lawyer to find out a strategy to use for your appeal and fire the old attorney.

Since you didn't post in Soc. Security forum :

You attorney already send in the Appeal , he/she didn't need your signature , because you initially signed papers with the Attorney to represent you .
