statutes of limitation running & arbitration

What is the name of your state? california

Anyone know if a case is dismissed with out prejudice if the statute of limitations starts to run again starting the day after the court orders it? and then can u file months later for arbitration and not be blocked?

What was the date of the incident that led to the lawsuit (what was the SOL date)?
Who filed the lawsuit and when was it filed?
Why was the lawsuit dismissed?
Who filed for arbitration and when?

a malpractice & fees case in a probate trust contest case & the date was sept 29 2006 & our atty filed on aug 17 2007

it was dismissed because there was an arbitration clause in the contract and everyone agreed to take it to arbitration and it was dismissed on dec 31 2007 and our atty just filed a demand for arbitration in mid april 2008 (around the 14th)
