Temporary OrdersWhat is the name of your state (only U.S. law)? TEXAS My wife and I have been going to court for close to a year regarding her daughter and custody. We went to court in June for her to get full custody instead of joint and won because the father did not show up. After it was over we decided to move so I could take a better job making more money. In the final order we were allowed to move at our descretion giving that we inform the other party in a reasonable manner. After doing so he filed a motion to modify on an account of a emergency situation. He also filed for a new hearing and we were temporarily restricted. He was denied a new trial but was awarded a trial for his motion to modify. Since than we have been in and out of court constantly delayed and have been restricted to the county. We got married last month and I have a great job in AZ and I am the sole source of income for our family. We still havent got anywhere with the court and we are being forced to pay rent on two places and have gotten more in debt trying to keep this going. What if anything can we do about our situation.What is the name of your state (only U.S. law)? |

| You did not mind standing by your girlfriend's side to fight her child's father against joint custody, which she happened to win by 'default'. Maybe you both figured it would make life easier... Follow this up with a quick move out of state and dad's pretty much out of the picture. The father is still the father and he has asserted his right to challenge a relocation of his child. If he wants to play legal hardball now it could be a long and expensive ride. And one your new wife may not win in Texas. There is absolutely nothing you can do except ride this out as long at it takes to resolve this dispute. The alternative would be for her to find some way to mediate this out of court, or leave the child with the father. However, as far as you are concerned there is no WE in these court proceedings or the final orders, only SHE, HE, and their child, since you are not a party to, nor do you have any legal standing in this case.
