Question

Is there anything wrong with my criminal court representation?

What is the name of your state (only U.S. law)? NY
I have legal representation by legal aid and she isn't asking for any paperwork nor any info to prove my innocence? She isn't calling me back nor she is prepared in court when it comes to my case. What rights do I have? Her law firm is the only firm that is being represented by legal aid here in Staten Island for Criminal court. Is there anything wrong with my criminal court representation or am I freaking out over nothing? And if there is something wrong what rights do I have to change court appointed lawyers and what I should do in my situation? For the record my plea in court was Not Guilty
It is important for me to have legal representation as my case is the second half of what happened on that night with the first one is against my ex-boyfriend who broke the order of protection by entering my residence and proceeded to rob me and beat me up. In that case the D.A is handling that which they suggest that my legal representation to advise me which she hasn't. Even being in court that day she wasn't available to the D.A regarding my compliance and questioning of what happened on that night. she is a full time legal aid lawyer as I am told by the D.A.

Ok I am being charged with 120.00(1) et al as written on my paperwork. I am being represented by legal aid which at this time I can not afford any lawyer. The woman who is assigned to my case was the same who was at my arraignment which at the time it was the only time she asked for any information about what happened and anything pertaining to my case. This happened on 11/04/2008 and my first court date was 01/07/2008. Between that span of time I have been leaving her countless messages for her to call me back as I wasn't even aware if she was even going to represent me! She has only called me back once between the timeframe 11/17/2008 to 12/23/08 to say she thought nothing was happening with my case cause there was no deposition from my son who is accusing me that i threw him down a flight of stairs. My next court date was 01/07/09, so you can only imagine my uneasiness with this as I found out not only did the D.A want to send me to 30 days in jail plus restitution she didn't even bother to represent me at my hearing a coworker of hers did. She was in the other courtroom. I had all copies of my paperwork regarding my sons emotional health as he is diagnosed with bi-polar disorder and is emotionally disturbed, and from ACS as they are planning to give him back to me as written in our latest meeting as he is in foster care while in court to sort everything out. They (ACS) already returned my daughter back into my custody within the first week it all happened. I have all documentation regarding this as well as programs and anything ACS has ever asked me to comply with. I have never committed any crimes nor have I ever gotten into ANY trouble. My next court date is on 02/19/2009 and since the D.A gave a plea bargan which was refused by the lawyer who represented mt the D.A was asked by the judge if they had any discovery which he replied No. Meanwhil while I was up there I had every document by mental health providers, Doctors and hospitals and ACS alike which would benifit my case no one bothered to even ask what I had or the copies regarding ACS I gave the lawyer representing me.

My case pertains a two-folded scenario that happened on the same night the second happening 20 min within the time the first responders left the scene.
One that pertains to my ex-boyfriend of 19 yrs and is the father of both of my children who is actively abusing drugs secondly my 17 yr old son who is emotionally disturbed and brought charges against me alleging I assaulted him after his father attacked me earlier on the same night and beat me up while the father was violating the active Order of protection I have in place.
In the meantime I have a case in family court and being represented by a court appointed attorney which is great in every way the only bad thing is that his firm doesn't have a pro bono rights regarding criminal court only in family court. What is the name of your state (only U.S. law)?
