Won Leagal Malpractice Bar wants to prove?


Oregon,
The Bar found the lawyer negligent, but before the insurance can do anything I now have to prove I would have won the original case. To which I would have with the evidence to support it. But now that I can't file the original case due to the Laywer incop. How do I prove it to the Bar? Any help would be great also would be looking for a Laywer not in Oregon for Leagal Malpractice. Thanks

Good for you for getting the attention of the Bar in your State. If you were suing the attorney for MALP then you would need to prove in the courtroom that you would have prevailed in the underlying case. If the MALP carrier is involved with you outside of the courtroom, you all should be in negotiations and there wouldn't be any need to "prove" the outcome of the case other than to provide the MALP carrier with your basis for the monetary claim. (p.s., I'm not a lawyer but am pursuing a case, pro se, in the VA courts).
