1995 Pontiac Grand Am


What is the name of your state (only U.S. law)? PA

Hey guys, I want to say thank you to everyone for your help beforehand. I'm a college student and I bought a car off of Craisglist from a guy but he worked at a care dealership. Here is my letter to the Better Business Bureau which was never responded to, more details on my case follow.

I bought a 1995 Pontiac Grand Am for $1,000 from John who worked at Matos Used Auto. I went to John's house to look at the car, John was not there, but he had somebody he was in business with by the name of Joe let us look at the car. John said he was a wholesaler for Matos Used Auto. After deciding to purchase the car, Joe brought us to Matos Used Auto where we paid Pablo, who was the owner of the dealership. Pablo said I could pay the full amount to Matos Used Auto by credit card, but I ended up paying $1000 in cash to Pablo, and paid for the tax and tags by credit card. Another woman came in to buy the car from the Matos used Auto but she was told the car was already sold which clearly shows that the it was in fact the dealership that sold me the car. I was told that everything was in good working order and that nothing was wrong with the car. When I asked the specific question of whether the engine was in good working order and if it leaked oil, they said that the engine was good and that it did not leak oil. I drove it home from the dealership and it stalled out five times and the heater didn't work on the way home so I called as soon as I got back home. John told me that he would come pick it up the next day to fix it. He never came the next day and I called and left a message with his friend Joe but never got a call back. I tried to drive the car to church the next day but it was leaking oil everywhere so I drove it right back to my house as soon as I saw this. My father spoke with John later that day and he said that he would come the next day and fix it but also mentioned that I only paid $1,000 for the car, so what do I expect and said that he would not give me my money back but he would fix it. He sent two guys to come check it out the next day with a tow truck and they said there was most likely a hole in the motor. The guys said that they were going to lunch and they would come back after they talked to John, but they never came back. I called John and he said he would have to talk to them and call me right back. He never called back and I tried calling him 3 more times that day without a response. The next day I called him and eventually got a hold of him and he said he would send someone Thursday to try to fix it. I called again yesterday and left him a message saying that the keys would be in the car. Nobody ever came today again and I want my money back. John has been hard to get in touch and at this point I would just like my money back because I could not even drive the car home without it stalling. Literally, 20 minutes after I took the car from the dealership the problems started. This obviously is a case of lemon law and also deals with implied and express warranties. I am a college student and do not have very much money and I was ripped off on this car and would like my money back.

The never responded and I found out the car will cost $2300 to get fixed. Should I take them to small claims court for the full amount it will take to get fixed and do I actually have a legit case? Thanks so much for all your help.

You have no case. Why didn't you DRIVE the car before you bought it?
And, for a 14 year old car, you should have had a mechanic check it out.
