Bought a bad car...

My mom recently was shopping around through private individuals for a used car. She ended up buying a Dodge Intrepid from a couple who claim there is absolutely nothing wrong with the car. (i told her to take it to a mechanic!!!)

anyways, today not only can she not get the title changed b/c the woman (the wife) owned it and sold it to her husband for a 1.00 on the title for whatever reason, but they told her the car was inspected but they lost the inspection slip.

So she goes to get it inspected and there are numerous problems with the car.

Anyone know what she should do? She is completely heartbroken now. I TOLD her not to trust ANYONE when buying a car. They can tell you ANYTHING to sell that car.

But she took their word for it.

i suggest, you go back to the couple and asked for refund. If they wont cooperate with you. next best thing is.. threaten to sue them for misleading and fraudlent sell. Then go find a lawyer and have the lawyer make up a demand or else letter. Usually they would negotitate. If that dont work. just take them to small claims court depends on how much the car is worth.

i think it only cost 80$ to 100$ to have the lawyer send out a demand or else letter.

i guess i should have mentioned that she paid about 5000 for the car.

i think i heard that small claims court goes up to 1000. eek!

Too bad she didn't listen to YOU. I don't understand why she is having a problem with the title; since the husband would be the one that would have released it to her.

Caveat emptor: "Let the buyer beware." The idea that buyers take responsibility for the condition of the items they purchase and should examine them before purchase.

here in missouri (i used to work at the license bureau) if the title has a sale on the back of it (in this case, the woman sold it to the husband for a 1.00) he can not sell it until the title is changed into his name. meaning, they order a new title, you can't just scribble something out on the back of a title...

they told my mom tonight on the phone they will give her her money back (although, i have a strong feeling they are just saying that) and that her mechanics are lying to her... (my cousin works for a dodge dealership as a mechanic and she took it to him earlier today and he confirmed that it would need about 2200 in repairs b/c of some leak in the engine).... we KNOW he's not lying to us about it.

anyways, the seller kept telling her again on the phone that the car is in perfect condition, nothing wrong at all with it. but now that he said he'll give her the money back, can we do anything if he changes his mind?

i understand about the whole "buyer beware" thing... he told my mom he wants the car back anyways b/c he is already "missing it"... i have a feeling these people are going to just disappear. their stories they tell my mom are very very very far fetched to begin with.

Try getting it in writing, otherwise it will be your mother's word against theirs.

Good luck, hopefully they do miss the car and your mother will be out of the deal.

....and next time make Mom listen to you.
