Completely Misrepresented in NJ, From Iowa

My father recently purchased a 1993 Ford Explorer off of Ebay up in New Jersey (He lives in Iowa). I agreed that I would go with him to go pick it up because he didn't wanna fly up there alone. When we got there, we were taken into an office and due to partial stupidity and partial being dog ass tired, we bought and signed for the explorer (Signed the credit card and the title). As we got out there, the explorer (Which was advertised as in perfect shape, no rust, running flawlessly), had a large amount of rust peaking from under the side skirts, some starting on the fender and alot of underbody rust. Ok, sucks for us, the interior was OK, so we through are bags in and started it up. Start the car, idling like it's down a cylinder or two until you rev it, smoke coming out of the tailpipe, sure enough, blown headgasket.

Alright, so it seems we got screwed, told the guy to give us the money back, he refused, we could do nothing at the but call the police and get an escort out. We get home, he tells us he will resell the car and give us HALF of the money back for whatever it resells for if we leave him positive feedback on Ebay. We refuse but the car goes up for sale anyway and gets sold later on. We fight and fight with the credit card company to get our money back but in the end, seeing as he signed the paper for the card, we're boned and the credit card company wont do anything for us. So he gets that money.

Later on, the credit cards call him back up to make sure the situation was resolved, and he is currently saying no, he still has the car waiting to be picked up because in the auction in the fine print, it says that there is a $10 a day storage fee. So now, after all this, he is claiming he still has the explorer (That was said was sold on ebay, we don't know if he still does have it or not). It has been about a year so we figure if this is true and he still has it, we're about to owe him $3500+ in storage fees or he could come back and put a lean on my fathers/mothers house and such.

We're 1300 miles away and my father is currently saying he wont do anything and can't do anything because the car was misrepresented, he has pictures of the Ebay auction, we have pictures of all the damage to the car so it's very clear it was misrepresented. But we no longer have Emails stating he would resell the car for us, nor do we have a printout of the second auction it was sold in.

I'm trying to tell my father that if he wanted to sit on it for 5 years, he could come back and put a lean on his stuff and collect the money or whatever he feels like due to the fact that he signed all the paperwork. My Father is saying he wont try to come after us and even if he did, chances are he wouldn't get very far in court due to how badly it was misrepresented.

Now I ask you, who do you believe is right here? Please tell me it's him because I do not want to see more cash handed over to this scum.
