Credit issues do to contract fraud

I am in a civil lawsuit against (Defendant) Northern Leasing Systems, Inc in New York sense Sept 2007 in the United States District Court for The District Of California. I am having troubles understanding the Federal Rules of Civil Procedure.

US Marshals has sent a Waiver of Service of Summons to the defendant in New York on 5/16/08, the defendant has up to 60 days to respond. 60 days is up and no responds. Now the US Marshals is going to attempt services. I don't understand and I'm not getting in answers.

All I want to know is the complaint served with the Waiver of Service of Summons? Sense no responds from the defendant, now the summons is serve along with another copy of the complaint and defendant has another 60 days to respond. If no responds then I file a default.....

I am getting a headache from all this and stressing... HELP HELP HELP

You should seek a consultation with an attorney. You seem to be in over your head.

well if you are not over your head then you would know exactly how service of process worked. and if you are the plaintiff and have a valid case you should be able to get an attorney to take the case on contingency, if no lawyer will take it without money up front, that should tell you you dont have much of a case.
