Fraud? Will this work?


What is the name of your state (only U.S. law)? NJ
Ok, to try and make a real long story short.
In a desperate attempt to get a car, I was introduced to a friend of a "friend". He showed me an 97 Eclipse RS. Car was sold to me AS IS for $3,600. However a few factors in this.
Picked up the car with more problems than previously stated. I know As is, means AS is. Regardless I brought it to a mechanic and the mechnic gave me a long list of really bad problems that he never mentioned. The car failed inspection and he was given "a long list" of things that wouldnt let it pass. This was only mentioned to me after I had given him a total of $2000. Is there any way i can use that to my advantage. Obviously i asked if there was anything wrong with the car and he stated No. But is that proof enough? He is still expecting 2 more payments on this car. One on the 30th of this month and the 30th of next month.
I do not plan on paying him this money, as the repairs alone cost $2000 alone just to get it at a "safe" driving level.

The title is currently in my name insurance plates everything. I cant get sued for non payment correct? I essentially want to give him back the car and get my money back on fraud charges. As that seems to be the only thing that would save me in this case. I know it was quite stupid of me not to have gotten the car checked out before hand. I geuss i trust people too easily, and dont expect to get screwed over.

Sorry, I forgot to mention. method of payments ths far have been checks payable to cash, i owe him $1600 more. He is refusing to give me back my money.
The car has not passed inspection in a while. He said it was just due to emmisions.
however, the list is endless, and the list contains problems never mentioned to me.


Just felt like clarifiyng the situation some more.

There's no fraud

Unless you find a law that says a private sale auto has to pass inspection , you bought it as-is .

If you do not pay the remainder , you can be sued for it .
