lemon law case settled...

What is the name of your state (only U.S. law)? Pennsylvania

I settled a lemon law case on my car. I signed the papers and sent them in to my attorney about 2 1/2 weeks ago. I am sure I will not get the check until September since they have 60 days to send out the check.

The question I have is this: I just found a great car and wanted to trade this one in. Will that affect my settlement if I trade it in before I get the check?

The car is not yours to trade in. By settling your lemon law case, you are selling the car back to the manufacturer/dealer. Part of getting the check will be turning the car over to one of the two.

I guess I wasnt that clear in my question. Sorry.

I settled the case for a lump sum of money (It is a small sum of money ) and I keep the car. I do not want to deal with this car anymore so I want to use the settlement money to put down on a new car. Since I came across a car that I liked I was planning on taking money out of savings until I got my settlement check.

I was just wondering if I could trade the car in before I actually had the check in my hand.

Knock yourself out. You are required by law to disclose that the vehicle was involved in a lemon law case.

Finally got a call back from the attorney that handled my case.

Just FYI : She said that Yes, I can trade the car in and could have as soon as I signed the settlement papers. She also said that since the case did not go to court and settled before any court hearing was scheduled I do NOT have to disclose it when trading it in.

The only problem I had with the car was a faulty gas door that was in for at least 20 attemts at fixing so I do plan on letting the dealer who is taking it in know. That may come back to bite me but we'll see. It worries me though wondering how many cars out there are lemons that had thier cases settled out of court.
