Nissan Dealership in Santa Monica made me drive an unsafe car....What is the name of your state? California I am not sure if this is the right place for my post but here's my story. I drive a 2004 Nissan 350z. I took in my car to the dealership because my car made clanking noise from the engine after driving for about an hour. They told me I needed a new transmission and that it was covered under warranty. When I went to pickup my car, everything seemed to be working just fine. But when I tried to shift to fifth gear, the shift nob would not budge into gear. It seemed like a piece of medal was in the way. It just would not go into fifth gear. I stopped my car and tried shifting to sixth gear and that was impossible. Luckily, no one was hurt and I took my car back to Nissan immediately. Do I have a viable case to perhaps seek monetary compensation? Nissan acknowledged that I was given an unsafe vehicle and apologized. Please help... | What exactly made this car unsafe? I don't see how being unable to shift in a specific gear will make a vehicle unsafe. An aggravation yes but not unsafe. You suffered no damages so you have no cause to seek compensation. You are not entitle to compensation for something that could have happened. That would be like someone wanting compensation because it is possible to be involved in a fatal accident in there car. There are certain risks we take in life, you took one by not making sure the car shifted into all the gears before you left the dealership.

| That's what i figured. Doesnt hurt to ask. I dont see how a car that doesnt shift into gear properly is safe though. Making sure that my gear goes into place is something I shouldnt have to check. That's what test drives are for. And they shouldve made sure all my gears go into place. Especially after changing my transmission. Last edited by venice350z; 08-25-2005 at 01:14 PM. |
