| Private Sale with verbal contract What is the name of your state (only U.S. law)? OH
I purchased a car about 12 days ago. The person selling the car said it ran perfect they had just replaced the engine and he had all the recite from the honda dealership where they had swapped the engine. So i agreed to the swap only if i we both agreed on a verbal agreement saying that we could swap back if I found a major defect within 14 days with a witness for both parties. I hadn't driven the car home and it blewout a tire and was found to be that a tire to large for the well had been put on the rim. Also found that the struts were not the right ones which also helped cause the blowout. When i had a mechanic look at the car he told me that the engine was painted with cheap paint and told me to run the car for an hour and you would probably find leaks. and he was right, the engine is leaking in 4 spots and the fuelrail/injectors are leaking enough gasoline to catch fire if you drive the car. I called the seller back and i demanded by car back he told me that he never agreed even though i am currently get a subpoena for my text massaging where i originally told him i wouldn't take the car inless he agreed to the agreement. I mean clearly this is fraud from them temporarily hiding the mistakes, but shouldn't the verbal agreement be enough? |
