Question

Seems I qualify for Lemon Law, but do I get a refund or replacement vehicle?


What is the name of your state (only U.S. law)? Florida

I have had not 3, but 5 visits to my Service Department for the same problem and they finally concluded they can't fix the problems my car has. I obviously qualify for the Florida Lemon Law, but I have read on it and all it says is that you're entitled to a full refund or replacement vehicle. What I'd like to know is what that "or" exactly means. When are you entitled to one or the other?

I wrote to Customer Service (I'd rather not mention the car make) and they asked me to contact my Sales Manager. I did and specifically stated I wanted to have my car bought back (it's a lease, actually) and he completely ignored this part and said he was sorry about the troubles, willing to help and asked me if I would take this or that other car as replacement.

When the law states I'm entitled to one or the other, is this to the discretion of the dealer or car manufacturer or something I get to choose? I do not know what to respond yet.

Hire a lemon law attorney. It will take some negotiations and threats of lawsuits to get the dealer to do anything. It also depends on the problem with your car.

They are suspension-related and the dealer said they were willing to work with me since the first e-mail I sent them. In fact, they asked if it was OK to trade for the same car. They just did not say anything about the buy back. I don't mean I will only consider that option. I just don't understand what the Lemon Law stipulates and whether a refund is made or a trade is provided is up to me, the dealer or the car manufacturer.

You might need to write a good old fashioned LETTER to them. Emails and phone calls don't seem to carry the same weight...
