Can i Sue for Defamation?

What is the name of your state (only U.S law)? IL the bottom line is that i have 2 daughters one is a angel we will call her (girl A) and one who is 3 months (girl B) Girl A passed away and was under the care of many specialists until she was placed on hospice and then passed away. Girl B started showing signs of the some condition but we now live in a different state. With no answers being found here i took her to Girl As doctors. There was then a medical neglect case started. A doctor has written a strongly worded letter stating that I harmed girl A even though he never met her or treated her and there are numerous doctors that did treat her that know that i have done nothing wrong. This has launched a huge mess for me and my family and i have no idea what my rights are. This letter has made me relive the death of my daughter to social workers and the accusations being made can be proved otherwise and this doctor had proof of girl As diagnosis.. looking to get a consultation and will then get into further detail.

First I want to say how sorry I am for your daughters death.

2nd...This isn't something a legal forum can assist you with. Yes you can sue...but "will you win"? There is no way we can tell you that. You need an attorney that has access to all medical records.

The report to children's services is protected, you can't sue based on that unless you can prove that it was a malicious report.

I am so sorry for the loss of your daughter, sesherman, and I am sorry that your second daughter is exhibiting signs of the same condition. I can only imagine the pain this is causing you and your other family members.

The fact that the doctor suspects abuse or neglect is difficult, but I agree with both Zigner and Blue Meanie. Unless the neglect and abuse allegations were made to others beside social services, there is no defamation - only an unconfirmed report that needs investigation.

You could also consider pointing the doctor and social workers to this site, to better educate them on the genetic defects and congenital defects and other medical disorders that are often misdiagnosed.
