    Copy of "5150" Police report

    What is the name of your state (only U.S. law)? CA

    I would like to get a copy of a police report in a 5150 case. I was told to get a lawyer by the police because I will need a Subpoena. What type of lawyer do I need? I am interested in finding out what my former supervisor said about me. I would like to pursue legal avenues to address this issue.

    You would be wise to get an attorney well-versed in civil rights laws.

    As a note, your supervisor (if this is a work supervisor) would not have been the one to initiate the 5150, even if the supervisor initiated the call to the police. A 5150 is applied when, in a face-to-face interview, the police determine that probable cause exists for the 72 hour detention and assessment. This probable cause must be carefully documented by the responding officer, and explained in detail.

    You have the right to inspect and copy the police report and the medical records. You are correct, however, that a subpoena may be necessary to obtain any confidential report made by your supervisor to the police or medical personnel.
