Email slander/defamation


What is the name of your state (only U.S. law)? Texas

I was wondering about email hacking and sending out email without the person's consent.

My email account was recently hacked and pictures of myself were sent to my entire contact that I did not wish to be given out. I am fairly sure that the person responsible knew my password since we shared the account while we were living together.

For this matter, is there a case against them, since I did not give my consent for them to send out the pictures or use my email since we no longer live together as of March of this year?

Under Texas Penal Code Ann. §33.01, a person needs to have "effective consent" in order to access another's computer data. Consent is not effective if access is used for a purpose other than that for which consent was originally given. To access a computer without effective consent is a Class B misdemeanor or, if harm to another results, is a Class A misdemeanor.

Even if this person had your password, then, access to your computer would not have been granted by you for the purpose of sending out photos to others. Whether this person hacked into your computer or gained access through use of your password, this person did not have "effective consent" and, therefore, he committed a computer crime.
