What is the name of your state (only U.S. law)? What is the name of your state (only U.S. law)? I live in Alabama. My boyfriend and his now ex fiancé ended their engagement several months ago but she is still living in the house that he owns. She left to go on vacation this week so I have been over there... She has been known to leave audio recorders and video recorders to try to catch him doing something wrong while they were together but of course nothing was on those recordings other than baseball games he watched and business phone calls he received. We are unsure if she left any video or audio recorders in the house this time or not. If she did there will be video of him and me in the act several times. How illegal is it if she did leave recorders (voice activated) in the house and has basically recorded porn without our consent? Is there anything that can be done about this if it happens to be true?

Well you homewrecking *word for loose woman* there is absolutely nothing wrong with her putting recording devices in HER home. I say its HER home because even if her name isn't on ownership papers (which btw how do you know they aren't) she's STILL technically a tenant and therefor would need to be legally evicted before he can make her leave. So yep, until said eviction happens or her name is removes its HER home and she can choose to do whatever she likes to catch her "ex" and his homewrecking floosie in sex acts. So if you want to know what you can "do" in the scenario its simple...stop sleeping with this guy in the home he still shares with his ex and you won't have any problems if she comes home, sees any video recordings, and chases you down the street like an angry bear.

Here is a link to the Reporters Committee for Freedom of the Press on Alabama recording laws:

http://www.rcfp.org/reporters-recording-guide/state-state-guide/alabama

The link provides the laws and the possible penalties for violating them.

The former fiancee cannot surreptitiously record private acts, this whether she remains a tenant in the home or not.

Except OP has already said boyfriend is aware the cameras might be present.

If he's chosen to do nothing thus far then would that be considered consent?

It would not be consent if neither the boyfriend nor PrincessSKS consented to being audio and/or video recorded by the fiancée and PrincessSKS and friend were recorded n an area of the house where they had a reasonable expectation of privacy

The woman could find herself in a legal mess if she recorded her fiance having sex and especially if she attempts to use or publish what she recorded.

Behold, the power of YouTube ...
And behold all of the legal actions that have been nicely supported in whole or in part against those who not only film their crimes but publish the self-incriminating video evidence on YouTube (or elsewhere).

Surreptitious recording is rarely a good idea - but those who consider it (for whatever reason) should know well the federal laws and the state laws that govern the recording of others.

I am never totally sure who is in the choir on this forum and who is tone deaf but after all of our years together, Pro, I think I have come to recognize your dulcet tones. No preaching to you is needed. :)
