Police/Sheriff: Who Gets Served?


IOWA

If I want to sue (civil action, false arrest, IOWA) a sheriff or a city police officer do I have to notify the county or city first, and if so, who exactly?

Call teh Sheriff or City Police and ask them the procedure for filing a claim.

OP you might be better off consulting with a local attorney first. That being said, usually the "police department" and the "sheriff's department" are entirely different entities....so you need to make sure WHICH of the two you actually want to move forward against.

A police or sheriff agency will give out information on how to file a claim. I agree that the OP needs to figure out exactly who he needs to sue, but getting information on the claim process doesn't require an attorney.
