What is the name of your state (only U.S. law)? SD
so is it illegal to take a video of someone and post it to the internet without their permission? They were not doing anything illegal.

It depends.

If the video is of a naked child running through a sprinkler or playing in the bathtub, it can get you arrested.

If it is of a person who values their privacy, it can get you sued.

And there are a whole lot of other "ifs."

The wisest move is always to get the permission of the people you videotape before publishing any video online or elsewhere.

Why would you want to post a video of someone on the internet without their permission? If you felt good about it, you wouldn't be here looking for confirmation that you wouldn't be (a) sued or (b) jailed.:confused:

The "why," I am guessing, is that the video would be used for either monetary gain (always a great motivator) or for some nefarious purpose (to humiliate, embarrass, ridicule. . . ). Or perhaps both. :)

Is oral permission good enough? You can't go shoving a pen under everyone's nose every minute.

Especially these days everyone's running around with lights and cameras. You don't want to turn the world into Pen Station.
