Beneficiaries

What is the name of your state (only U.S. law)? In Texas the insured was murdered by the beneficiary (spouse) with no alternate beneficiaries named. The insured had no children and no will. Insured parents are living and the spouse is still living but incarcerated. Who would have rights to the policy if anybody?

If the decedent had brothers and sisters, the estate will go to them, and if he didn't have siblings, then it goes to the parents. Someone needs to file to get probate opened up so that they can process the check that the insurance company will issue to the estate.

Actually, the parents have priority over siblings under Texas intestate succession.
