my father inlaw had a policy for 18 years with the beneficiaries his two daughters. Two ex-wives were never put on cause it was for his children. He became ill september 13 and gave his girlfriend power of attorney on september 18th, needless to say she changed the policy herself from a 50/50 split with daughters to 10/10 split and 80% for herself october 4th. he passed in november and we just found all this out. he had a will, and when asked, she just says "he had nothing" she's wont reveal the will to his daughters. Can the POA be challenged? can POA change benefic. after 18 years of no change?? how do we gain control of this claim??What is the name of your state?

There are various types of POA. Also the person given the POA may be given broad powers or restrictive powers - such as restricting the change of bene on life ins. policies. If there was a will, probate needs to be opened. You may want to get help from an attorney to protect everyone's interests.

In many states the POA is not allowed to change beneficiary designations and this is most times considered as abuse of POA. You or your attorney need to inform the insurance company that you are filing a protest to her claim so they won't pay her until an investigation is done.

If your father-in-law has other assets besides the life insurance, then you need to get an attorney to open up probate so the judge can ask whoever has the will to produce it.
